Terms of Use

1. Acceptance and scope

DrAxe.com is operated by Axe Media Inc. (“Axe Media,” “we,” “us,” or “our”). These Terms of Use govern the site and the educational services we offer on it, including articles, quizzes, accounts, Ask Dr. Axe, and the planned bloodwork Marker Reader (the “Services”). References to a planned tool describe its intended use when available; they do not promise a launch date or availability.

Once these Terms take effect, using the Services or accepting these Terms means you agree to them. If you do not agree, do not use the Services. A parent or legal guardian who permits an eligible minor to use the Services agrees to these Terms on the minor’s behalf to the extent permitted by law.

Our Privacy Policy explains our information practices. The Medical Disclaimer explains the limits of our health content. Where we request health information, the Health Information Release & Consent describes the proposed collection, use, retention, and your choices. Agreeing to these Terms alone does not supply any separate health-data consent required by law.

2. Eligibility

You must be at least 18, or have a parent’s or legal guardian’s permission and supervision where the law allows a minor to use the Services. The Services are intended for adults. Children under 13 may not create an account or submit personal information; a higher minimum age applies where required by law. Parental permission does not override those restrictions or a feature’s higher age requirement.

Do not submit another person’s health information, including a child’s records, through your account or the Marker Reader. Contact help@draxe.com if a child has submitted information. Counsel is reviewing the age and consent rules before health-data tools launch.

3. Education, not medical care

Our content reflects the published work and editorial direction of Dr. Josh Axe, DNM, DC, CNS. The Services provide general health education. They do not provide medical advice, diagnosis, treatment, prescriptions, or clinical monitoring. Using them does not create a doctor-patient or other clinician-patient relationship with Dr. Axe, Axe Media, or a contributor.

Personalized quiz results, AI responses, and comparisons of lab values remain educational. Consult a qualified clinician about your symptoms, test results, medications, and care. Never delay care or change prescribed treatment because of something on this site. For a medical emergency in the United States, call 911 immediately. Do not wait for a chat response, reading, or email reply.

4. Accounts and magic links

Accounts use your email address and a sign-in link sent to that address. Provide an email you control and keep it current. Protect your inbox and device, do not forward sign-in links, and sign out on shared devices. Someone who can access your email or a valid sign-in link may be able to access your account and its saved information.

Creating an account also subscribes you to email from Dr. Axe: new articles, the weekly report, and occasional offers from Axe Media. You can stop marketing email at any time from your account settings or the link in any message; essential account email, such as a sign-in link you requested, continues while you keep an account.

You are responsible for your use of your account and for reasonably protecting access to it. Tell us promptly at help@draxe.com if you suspect unauthorized access. You may not impersonate someone, use an address without permission, or transfer access to another person. These responsibilities do not excuse our own security obligations or remove rights you have under law.

5. Acceptable use

Use the Services lawfully and with respect for other people. You may not:

• Harass, threaten, defraud, impersonate, or violate another person’s privacy or intellectual property rights.
• Upload malicious code, interfere with the Services, probe accounts without authorization, or bypass access controls, rate limits, or safety restrictions.
• Use automated tools to extract content or health information in bulk without our written permission, except where applicable law permits it.
• Submit material you have no right to provide, including someone else’s lab report or confidential records.
• Present our content or a generated reading as a clinical diagnosis, a prescription, an emergency service, or an endorsement of your own product or service.
• Use the Services to carry out unlawful activity or to facilitate harm to others.

6. Your content and submissions

You retain any rights you have in the material you submit, including lab values, quiz answers, chat messages, and feedback. You are responsible for having permission to submit it and for its accuracy to the best of your knowledge. We do not verify lab reports, identities shown on a report, units, transcription, or the completeness of the health history you provide.

You give Axe Media a limited, nonexclusive, royalty-free permission to receive, store, process, reproduce, and display your submissions as necessary to provide the Services you request and carry out the uses described in the Privacy Policy and any applicable health-data consent. Service providers acting for us may process submissions for those purposes. This permission is not a transfer of ownership or permission to publish your private health information, advertise with it, sell it, or use it for unrelated purposes.

Permission to retain or process personal information ends in accordance with your deletion or withdrawal request, applicable law, and the retention terms explained in the Privacy Policy and Health Information Release. It is not a perpetual license to your health information. Feedback does not authorize public use of your name, testimonial, or health story without separate permission.

7. Our content and intellectual property

The Services’ articles, images, branding, designs, software, and other content belong to Axe Media or their respective owners and are protected by applicable intellectual property laws. We permit you to access and use the Services for your personal, noncommercial learning, including keeping a personal copy of a reading. Do not remove attribution or proprietary notices.

Except for rights allowed by law, including fair use, you need permission from the relevant owner to republish, sell, distribute, or commercially exploit protected content. Linking to an article does not transfer rights in it. AI-generated output may be similar to output provided to others; we do not promise exclusivity or that every output qualifies for copyright protection.

For permissions or an infringement concern, email help@draxe.com with the page address and enough detail to identify the work and concern. Copyright infringement notices under the Digital Millennium Copyright Act follow the procedure in our DMCA Policy.

8. Third-party services and links

The Health Institute (“THI”) is a separate company. Bloodwork panels, consultations, and clinical programs offered through THI are provided on THI’s own site under its own terms, privacy practices, eligibility rules, pricing, cancellation policies, and clinical arrangements. Following a DrAxe.com link does not enroll you in THI care or authorize transfer of your health information. DrAxe.com does not maintain THI’s clinical records.

The site also links to Ancient Nutrition products and other outside resources. Dr. Axe’s relationship with Ancient Nutrition is described in our editorial policy. Purchases on another site are agreements with that seller, subject to its own product information, prices, shipping, refund rules, and privacy policy. We do not control third-party sites, and a link is not a guarantee of a product’s safety, suitability, or results.

Any paid service offered directly by Axe Media must disclose its price and applicable purchase terms before checkout. These Terms do not themselves authorize a charge or recurring subscription.

9. Ask Dr. Axe and automated output

Ask Dr. Axe is an AI tool, not a live conversation with Dr. Axe or a clinician. It generates responses using his published teachings. Responses may contain mistakes, omissions, outdated information, or inaccurate references, even when they sound confident. They are not individually approved by a clinician before you see them. Check important information with reliable sources and your own clinician.

The assistant does not monitor emergencies or arrange care. Do not use it to decide whether urgent symptoms need attention. Do not include another person’s private information or unnecessary identifiers in a message.

Authorized personnel may review limited conversations for quality and safety within the purposes and access limits described in the Privacy Policy and Health Information Release. AI service providers process messages to generate responses. We do not keep conversations beyond the retention allowed by the Privacy Policy and applicable health-data terms. This section does not authorize additional storage or unrelated model training.

10. Disclaimer of warranties

To the fullest extent permitted by applicable law, the Services are provided “as is” and “as available.” Axe Media disclaims express and implied warranties, including merchantability, fitness for a particular purpose, and noninfringement. We do not warrant that the Services will be uninterrupted, error-free, completely secure, accurate in every instance, or suitable for your health circumstances, or that using them will produce a particular result.

These disclaimers do not limit an express commitment in our Privacy Policy or applicable consent, or exclude warranties or consumer protections that cannot lawfully be excluded.

11. Limitation of liability

To the fullest extent permitted by law, Axe Media and its officers, employees, and contributors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, arising from use of or inability to use the Services, even if advised that such damages were possible.

Subject to the exceptions below, our total liability for claims arising from the Services is limited to the greater of $100 or the amount you paid Axe Media for the Services in the 12 months before the event giving rise to the claim. This is a proposed allocation of risk for counsel’s review.

Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence where such a limitation is prohibited, or any other liability or statutory remedy that cannot lawfully be limited. Your nonwaivable privacy and consumer rights remain intact. Some jurisdictions do not allow particular exclusions or limits, so those provisions apply only as far as the law permits.

12. Indemnification

To the extent permitted by law, you agree to indemnify Axe Media against reasonable losses, damages, and legal costs arising from a third-party claim caused by your unlawful use of the Services, infringement of that party’s rights through your submissions, or intentional or materially harmful breach of these Terms. This does not cover losses caused by our own wrongdoing or your lawful exercise of privacy or consumer rights.

We will notify you of such a claim, allow reasonable participation in its defense, and not agree to a settlement requiring an admission, payment, or other obligation from you without your consent. Counsel will review the scope and enforceability of this provision for consumer use.

13. Suspension and termination

You may stop using the Services at any time and request account deletion at help@draxe.com. We may restrict or terminate access for a material violation of these Terms, a security or safety risk, or a legal requirement, or discontinue a feature. Where reasonably possible and lawful, we will provide notice and an opportunity to address a violation. Urgent protective action may occur without advance notice.

Ending access does not erase your rights to request your information, withdraw consent, or seek deletion. Information is handled under the Privacy Policy and Health Information Release. Provisions intended to address past conduct, ownership, and disputes survive termination only as permitted by law; they do not create new permission to retain health information.

14. Changes to the Services and these Terms

We may update these Terms and change the Services. Revised Terms will identify their version and effective date. For material changes, we will give advance notice through the site or email where appropriate and obtain renewed agreement when required by law. Changes do not retroactively remove accrued rights. A Terms update alone does not authorize a new use of health information that requires separate consent.

15. Governing law

Subject to applicable federal law and mandatory protections in your place of residence, these Terms are governed by the laws of the United States and the State of Tennessee, without regard to conflict-of-law rules.

16. Dispute resolution

You may contact help@draxe.com to try to resolve a concern. Doing so does not waive a right or shorten a filing deadline.

Subject to mandatory protections in your place of residence, any legal proceeding arising from these Terms or the Services will be brought in the state or federal courts located in Davidson County, Tennessee, and you consent to the jurisdiction of those courts. Nothing in these Terms limits a right that cannot be limited by applicable law, and these Terms do not impose mandatory arbitration or waive your right to a jury trial or to participate in a class action.

17. General provisions

If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. A delay in enforcing a provision is not a waiver. These Terms and any separately accepted terms for a particular Service describe the agreement for that use; nothing here overrides mandatory law or the express privacy and health-data commitments applicable to your information.
